California: Manufacturers of toluene containing nail polishes must submit Priority Product Notification from January 2023

The Office of Administrative Law (in the state of California) approved a petition by Department of Toxic Substances Control (DTSC) to designate Toluene-Containing Nail Products as Priority Products on November 14, 2022. This law applies to both nail coatings and nail polish thinners. The law also established a 100-parts-per-billion Alternatives Analysis Threshold (AAT) for toluene in nail products (ppm). This rule goes into effect on January 1, 2023. Domestic and international makers of toluene-containing nail products selling in California must file a Priority Product Notification (PPN) by March 2, 2023. The PPN must include all of the manufacturer's goods containing toluene, either as an added ingredient or as a contaminant.
