Indonesia Releases Draft Regulation for Online Sales of Cosmetics and Food

Indonesia's revised Regulation Concerning the Control of Drug and Food Online Distribution released 1st draft on 21 August 2023 and 2nd draft on 22 January 2024. The second draft focuses on regulating the criteria for online sales of drugs and food, including cosmetics, which must have a notification number. Business actors and third parties must ensure product packaging remains intact, deliver in a securely closed container, maintain appropriate delivery conditions, ensure product delivery to their intended destination, and document product handovers. Certain cosmetics are prohibited from selling online, including skincare products with more than 10% alpha hydroxy acid (AHA), teeth whitening products with more than 6% hydrogen peroxide, and refillable cosmetics. Supervision and inspection of cosmetics distributed online involve inspection, coaching, and assistance in obtaining business licenses. If non-compliance is found, the Food and Drug Supervisory Agency can issue an order to the electronic system operator, blocking or closing the Access Uniform Resource Locator.
